Welcome to Praatbox. These Terms of Service ("Terms") govern your access to and use of our AI-powered chat widget service. By using Praatbox, you agree to be bound by these Terms.

1. Service Description

Praatbox provides an AI-powered chat widget that can be embedded on websites to:

  • Automatically respond to visitor inquiries using artificial intelligence
  • Enable live agent intervention when needed
  • Provide analytics and conversation management tools
  • Support multiple languages (Dutch, English, German)

2. Account Terms

2.1 Registration

To use Praatbox, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

2.2 Account Responsibility

You are responsible for:

  • All activities that occur under your account
  • Ensuring authorized access to team members
  • Promptly notifying us of any unauthorized use
  • Keeping your contact information up to date

2.3 Age Requirement

You must be at least 18 years old to create an account and use our service.

3. Acceptable Use

You agree not to use Praatbox to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, spam, or harmful content
  • Harass, abuse, or harm others
  • Collect personal data without proper consent
  • Impersonate others or misrepresent affiliation
  • Interfere with or disrupt the service
  • Attempt to gain unauthorized access to systems
  • Use automated systems to abuse API limits

4. Subscription and Payment

4.1 Plans and Pricing

Praatbox offers subscription plans (Starter, Professional, Business) with different features and conversation limits. Current pricing is available on our website.

4.2 Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed securely through Stripe
  • All prices are in Euros (€) and exclude applicable taxes
  • You authorize us to charge your payment method on a recurring basis

4.3 Free Trial

We may offer a free trial period for new accounts. At the end of the trial, your subscription will begin unless you cancel before the trial ends.

4.4 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

4.5 Price Changes

We may modify pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of new pricing.

5. Intellectual Property

5.1 Our Rights

Praatbox, including its design, features, and technology, is owned by Kaya Core Inc. and protected by intellectual property laws. You may not copy, modify, or reverse engineer our service.

5.2 Your Content

You retain ownership of your content (chat configurations, branding, uploaded materials). You grant us a license to use this content solely to provide the service.

5.3 Chat Data

Conversations between your visitors and the Praatbox widget remain your property. We process this data only to provide and improve the service.

6. Widget Embedding

You may embed the Praatbox widget only on websites you own or have authorization to modify. You must:

  • Configure allowed domains in your security settings
  • Ensure your website's privacy policy covers the chat widget
  • Not remove or hide Praatbox branding (unless on Business plan)
  • Not modify the widget code in unauthorized ways

7. AI-Generated Responses

Praatbox uses artificial intelligence to generate responses. You acknowledge that:

  • AI responses may not always be accurate or appropriate
  • You should review and customize AI behavior for your use case
  • You are responsible for the accuracy of information provided to visitors
  • AI responses should not be relied upon for medical, legal, or financial advice

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for service interruptions due to factors beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • We are not liable for lost profits, data loss, or business interruption

10. Indemnification

You agree to indemnify and hold harmless Kaya Core Inc. and its affiliates from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

11. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Fail to pay for your subscription
  • Engage in fraudulent or abusive behavior
  • Pose a risk to our service or other users

Upon termination, your right to use the service ceases immediately. We may delete your data after a reasonable retention period.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of the State of Delaware.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on our website. Continued use after changes take effect constitutes acceptance.
